These Terms of Use ("Terms") govern your use of the Uptake mobile application ("Uptake," "the App"), operated by Boring But Good LLC ("we," "us," "our"). By installing or using the App, you agree to these Terms. If you do not agree, please do not use the App.
1. Eligibility
You must be at least 13 years old to use Uptake. If you are under the age of majority in your jurisdiction, you may only use the App with the involvement of a parent or guardian.
2. Not Medical Advice
Uptake is a habit and routine tracking tool. It is not a medical device, and we are not your healthcare provider.
The information, suggestions, and AI-generated responses provided by the App are for general informational purposes only. They are not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider before starting, stopping, or changing any supplement, medication, or health regimen, especially if you are pregnant, nursing, have a medical condition, or take prescription medications.
The AI coach can make mistakes. Do not rely on it for medical decisions. If you think you are experiencing a medical emergency, call your local emergency number immediately.
3. Your Account and Device
Uptake identifies you by your device rather than by an account. You are responsible for keeping your device secure. If you lose access to your device or transfer it to someone else, your local profile, intake history, and journal entries may be lost or accessed by the new owner.
4. Use of the App
You may use Uptake only for lawful, personal, non-commercial purposes. You agree not to:
- Use the App in violation of any applicable law or regulation
- Reverse engineer, decompile, or attempt to extract the source code of the App, except as permitted by law
- Interfere with, disrupt, or attempt to gain unauthorized access to the App, our servers, or other users' devices
- Submit content (including product corrections, photos, or chat messages) that is unlawful, infringing, harmful, deceptive, or contains personal information about others
- Use the App to harass, harm, or impersonate any person
- Use automated systems (bots, scrapers) to access the App
- Resell, sublicense, or commercially exploit the App or its content
5. User Content
When you submit content to Uptake — including product information, corrections, label photos, journal entries that you choose to send to the AI coach, and chat messages — you grant us a worldwide, royalty-free license to use, store, reproduce, modify, and display that content for the purpose of operating and improving the App.
For product information and corrections specifically, you understand and agree that this content may be added to our shared supplement catalog and made available to other users of the App.
You are responsible for the content you submit. Do not submit photos or text that contain other people's personal information.
6. AI Features
Uptake uses third-party AI providers to parse supplement labels and to power the AI coach. AI output can be incorrect, incomplete, or misleading. You are responsible for verifying any information before acting on it. See our Privacy Policy for details on what data is sent to AI providers.
7. Subscriptions and Purchases
Uptake may offer paid features through in-app purchases or subscriptions processed by the Apple App Store. If you purchase a subscription:
- All payments are handled by Apple under Apple's terms.
- Subscriptions auto-renew unless you cancel through your Apple ID settings before the renewal date.
- Refunds are handled by Apple according to their policies.
- We may use a third party (such as RevenueCat) to manage entitlements.
If any paid feature is materially changed or removed, we will provide reasonable notice.
8. Intellectual Property
Uptake, including its design, code, branding, and original content, is owned by Boring But Good LLC and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal use, subject to these Terms.
Supplement product names, brand names, and label content remain the property of their respective owners. The shared product catalog reflects factual information from product labels and is provided for informational purposes.
9. Disclaimers
The App is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted operation.
We do not warrant that the App, the shared product catalog, AI-generated responses, or any other content is accurate, complete, current, or suitable for any particular purpose.
10. Limitation of Liability
To the fullest extent permitted by law, Boring But Good LLC and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the App.
Our total liability for any claim arising out of or relating to these Terms or the App is limited to the greater of (a) the amount you paid us in the twelve months before the claim, or (b) US$50.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.
11. Termination
You may stop using Uptake and uninstall the App at any time. We may suspend or terminate your access to the App if you violate these Terms or use the App in a way that risks harm to us, our users, or third parties.
Sections that by their nature should survive termination (including Sections 5, 8, 9, 10, and 13) will survive.
12. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date above and, for material changes, provide notice in the App or on our website. Your continued use of Uptake after changes take effect means you accept the updated Terms.
13. Governing Law
These Terms are governed by the laws of the State of Idaho, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the App will be brought exclusively in the state or federal courts located in the State of Idaho, and you consent to the jurisdiction of those courts.
